1. Definitions
- “Auctioneer” refers to Bond Auctions, the entity facilitating the auction and selling goods.
- “Buyer” refers to the individual or business placing bids and purchasing items through the auction platform.
- “Lot” refers to an item or group of items listed for sale by the Auctioneer.
- “Hammer Price” refers to the final bid price at which a Lot is sold.
- “Buyer’s Premium” refers to any additional fee charged on top of the Hammer Price.
- “Reserve Price” refers to the minimum price set by the Auctioneer for a Lot.
2. Auction Process
- All auctions are conducted in accordance with UK auction laws and regulations.
- Buyers must register an account and agree to these terms before placing bids.
- Bids placed are legally binding. Once the hammer falls, the Buyer is obligated to complete the purchase.
- The Auctioneer reserves the right to refuse bids, withdraw Lots, or cancel sales at its discretion.
3. Payment & Fees
- Buyers must pay the Hammer Price plus any applicable Buyer’s Premium, VAT (if applicable), and shipping fees.
- Shipping fees are added at checkout for applicable items.
- Buyers requiring specialist delivery or collection may request alternative arrangements, such as custom delivery quotes for larger items.
- Payment must be made within 7 days via online debit or credit card.
- Failure to complete payment within the specified timeframe may result in cancellation of the sale and legal action.
4. Consumer Rights & Auction Law Compliance
- Buyers purchasing new goods are protected under the Consumer Rights Act 2015, ensuring items are of satisfactory quality, fit for purpose, and match their description.
- Buyers purchasing second-hand goods acknowledge that items are sold as seen, and may not be eligible for refunds unless misrepresented.
- The Auctioneer must provide accurate descriptions of Lots, including known defects or imperfections.
- Buyers are encouraged to inspect items before bidding. If physical inspection is not possible, detailed descriptions and images will be provided.
5. Refunds & Disputes
- Refunds are only available if an item is faulty or misdescribed under UK consumer law.
- Buyers must notify the Auctioneer within 14 days if they believe an item does not meet its description.
- Disputes will be handled in accordance with UK auction regulations and may involve third-party mediation.
6. Collection & Delivery
- Standard shipping costs are automatically calculated and added at checkout for eligible items.
- Buyers may arrange collection directly with the Auctioneer for certain items.
- Specialist delivery options (e.g., oversized items requiring custom quotes) must be agreed upon prior to purchase.
- The Auctioneer is not responsible for any damage or loss once the item has been collected or dispatched.
- Any additional shipping costs beyond standard checkout fees are the responsibility of the Buyer.
7. Liability & Indemnity
- The Auctioneer is not liable for indirect or consequential losses arising from auction transactions.
- Buyers agree to indemnify the Auctioneer against any claims arising from their use of the auction platform.
8. Governing Law & Jurisdiction
- These Terms and Conditions are governed by the laws of England and Wales.
- Any disputes will be resolved in the courts located in England.
